Plain English summary: We build your menu and run your ordering system. You pay a one-off launch fee and a flat monthly or annual subscription. We are not responsible for the accuracy of menu information you provide — that's on you. We don't take a cut of your sales. If you stop, you stop.
1. About This Agreement
These Terms of Service ("Terms") govern access to and use of the OnlineMenu platform ("the Service") operated by LivewireSolutions ("we", "us", "OnlineMenu"), New Zealand. By accepting a trial invitation, making payment, or continuing to use the Service, you ("the venue") agree to these Terms.

2. What the Service Is
OnlineMenu is a table ordering and kitchen workflow system for New Zealand cafés. We build and host a digital menu for your venue. Customers scan a QR code, browse your menu on their phone, and place orders that go directly to your kitchen display — without staff at the till.
OnlineMenu is a technology service. We are not a food service provider, delivery platform, or payment processor. We do not take commission on orders.
3. Trial Period
New venues receive a minimum 30-day free trial. The system is live from day one of the trial — your customers can order immediately. We post a Trial Pack (poster and owner guide) to your venue when the trial begins. No credit card is required during the trial. If you choose not to continue, there is no charge and no obligation.
4. Fees and Payment
Launch fee: A one-off fee of NZD $195 (inclusive of GST if applicable) is payable when you choose to continue after your trial. This covers your full menu build, your Starter Pack posted to your venue, and all setup costs. This fee is never charged again.
Subscription: After payment of the launch fee, the subscription fee is:
- Starter plan: NZD $59/month (single venue) or NZD $590/year
All prices are in New Zealand dollars. Subscriptions are billed in advance. There are no per-order fees, commissions, or hidden charges.
Payment: Currently by bank transfer or agreed payment method. An automated payment system will be introduced in due course. We will notify you in advance of any change to the payment process.
GST: OnlineMenu will charge GST when required by NZ law. If GST applies to your subscription, it will be shown on your invoice.
5. Cancellation
You may cancel your subscription at any time by emailing hello@onlinemenu.co.nz. Cancellation takes effect at the end of your current billing period. No refunds are given for the current billing period. The launch fee is non-refundable once the menu has been built and the Starter Pack posted.
We reserve the right to suspend or terminate access for non-payment, misuse of the platform, or conduct that causes harm to other venues or customers. We will provide reasonable notice before suspension where possible.
6. Your Menu — Accuracy and Content
You are responsible for the accuracy of all menu content, including item names, descriptions, prices, and availability. We build your menu from information you provide (photo, PDF, or other format). We are not responsible for errors in the information you supply.
Allergen and dietary information: OnlineMenu displays menu content as provided by you. We are not responsible for the accuracy of allergen, dietary, or nutritional information. It is your responsibility as the venue to ensure that menu information is accurate and that customers with dietary requirements are directed to speak with your staff. The allergen disclaimer displayed to your customers reads: "Menu information is provided by the venue. If you have dietary requirements or allergies, please confirm with staff before ordering."
You must not use the Service to list items that are illegal, offensive, or otherwise inappropriate. We reserve the right to remove content that violates this requirement.
7. Service Availability
We aim to keep the Service available at all times, but we make no guarantees of uptime. The Service runs on shared hosting infrastructure, which means occasional outages can occur without notice. We will notify you as promptly as practicable if we become aware of a significant outage affecting your venue. We are not liable for losses arising from service interruptions.
8. Your Data
Your venue data (menu content, order history, admin email) is stored on New Zealand-based servers. We do not sell your data or share it with third parties except as required to operate the Service (for example, sending email via our email delivery provider). See our Privacy Policy for full details.
You retain ownership of your menu content. If you cancel, we will retain your data for 90 days before deletion, during which time you may request a copy by emailing us.
9. Customer Orders
Orders placed by your customers through the OnlineMenu system are agreements between the customer and your venue. OnlineMenu is the technology through which orders are transmitted — we are not a party to the transaction. Any disputes between customers and your venue are your responsibility to resolve. We can provide order records from our system to assist in dispute resolution.
10. Limitation of Liability
To the fullest extent permitted by NZ law, OnlineMenu's liability for any claim arising from use of the Service is limited to the total subscription fees paid by you in the three months immediately preceding the claim. We are not liable for: lost revenue, loss of customers, business interruption, data loss, allergen-related incidents arising from inaccurate menu information, or any indirect or consequential loss.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under NZ law.
11. Changes to These Terms
We may update these Terms from time to time. We will notify you by email at least 14 days before any material changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not accept the updated Terms, you may cancel before they take effect.
12. Governing Law
These Terms are governed by the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of the New Zealand courts.
